A lorry driver has been sentenced to 12 months in prison after admitting guilt to two charges associated with the death of TikTok influencer A Rajeswary, known as Esha. The 29-year-old was found dead at her residence in Setapak, Kuala Lumpur, on July 5, just a day after she lodged a police report alleging harassment on TikTok.
Judge Siti Aminah Ghazali of the Kuala Lumpur Sessions Court sentenced B Sathiskumar, 40, after he changed his plea to guilty on two charges during yesterday’s proceedings. The court has mandated that he serve 12 months for each charge, to be served concurrently starting from the date of his arrest on July 10, as reported by Harian Metro.
Prior to his sentencing, the father of three expressed his remorse and acknowledged his wrongdoing, promising not to repeat his actions.
“I am guilty. I won’t do it again. I ask for forgiveness, ma’am (judge),” he stated from the dock.
In the first charge, Sathiskumar was accused of deliberately making obscene comments aimed at causing harm to others through his TikTok account, Dulal Brothers 360. This offense reportedly took place at 10.12pm on June 30, with the remarks being made at Jalan Ipoh, Sentul.
The charge was framed under Section 233 of the Communications and Multimedia Act 1998, concerning the misuse of network facilities, which carries a penalty of up to one year in prison, a fine of up to RM50,000, or both, upon conviction.
For the second charge, Sathiskumar was accused of degrading Esha’s mother, R. Puspa, 56, using the same TikTok profile at the same date, time, and location. The charge was brought under Section 509 of the Penal Code, which stipulates a maximum penalty of five years’ imprisonment, a fine, or both, upon conviction.
Earlier, Deputy Public Prosecutor Sabri Othman requested the court to impose a custodial sentence, emphasizing the seriousness of the offense, the public interest, and the rights of the victim. In contrast, defense lawyer Izwan Ishak, representing the National Legal Aid Foundation, argued for a more lenient sentence, stating that Sathiskumar earns only RM1,200 a month while supporting his disabled wife and three children.
